That night the family was driving home from Zah'Layah's grandmother's house. Hicks says the last thing her daughter asked her was whether she could have a Hot Pocket when they got home. She said yes.
After learning of her death, a local funeral home offered to hold her services at no cost to the family.
What Happened on Grant Road
Around 11:30 p.m. on Saturday, September 19, Hicks was driving on Grant Road near Jones Road with her five children, all under the age of 10, when shots were fired into the car. Zah'Layah was struck and later pronounced dead at a hospital. Two of the other children had minor injuries from broken glass.
Hicks says the shots came from a white four-door Ford truck. She told reporters she did not cut anyone off, did not exchange words with anyone and had not noticed the truck before the shooting began. Harris County Sheriff Ed Gonzalez said automated license plate reader cameras played an important role in the investigation, helping detectives quickly develop leads. Deputies arrested Jeremy Porter, 47, on Sunday night, September 20, and he was charged with capital murder.
Under Texas law, a murder charge can be raised to capital murder when the victim is under 10 years old.
What Porter Told Police
